Before you start touring homes with an agent, understand the services you’re receiving, how compensation works, and what you’re agreeing to.

Under NAR’s practice changes effective August 17, 2024, MLS participants working with buyers must enter into a written buyer agreement before an in-person or live virtual home tour.

Read the agreement before signing. Discuss the services, compensation, length of the agreement, and how it can end. Broker compensation is negotiable and is not set by law.

A seller can still agree to contribute toward buyer-agent compensation. Offers of that compensation cannot be displayed in the MLS under these rules. Don’t assume a seller contribution will cover your agreement. Understand your potential responsibility before making an offer.

For sellers, compensation is also a conversation. Your listing broker must obtain your written approval before offering or paying compensation to another broker acting for a buyer.

The useful next step is a clear discussion before you commit. Ask questions until you understand the agreement and the costs.

Read NAR’s buyer and seller guides, or contact The Kromm Team at Real Broker to discuss your plans.
